1. Eligibility: Entrants must be: (i) a legal resident of the 50 United States or the District of Columbia; and (ii) at least 18 years of age at the time of entry. Employees of Frost Bank and McGarrah Jessee (including employees of any of their respective parent, affiliate or subsidiary entities) are not eligible to win. The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law. Information about entrants will not be shared with third parties and will be used solely for the purpose of notifying the winners.

2. Contest Period: The Contest begins at the time it is posted on Facebook and ends at the time specified in the post (the “Contest Period”).

3. How to Enter: Entrants must enter in the “Comments” section for the specific post made by Sponsor on Facebook an answer to the trivia question posed in the applicable post (individually an “Entry” and collectively the “Entries”). Limit one Entry per person. Each Entry must be submitted in accordance with the instructions during the Contest Period. Only Entries submitted during the Contest Period as described herein will be eligible to win. All properly submitted Entries will be automatically entered into the Contest. Entries in excess of the stated limits will be disqualified. The website’s database clock will be the official timekeeper for the Contest. In the event of a dispute concerning the identity of any entrant, the relevant Entry will be deemed submitted by the authorized holder of the applicable Facebook account used to enter. Sponsor may run multiple ACL Live Ticket Giveaway Contests, simultaneously or over time, using different trivia questions. Each separate trivia question constitutes a separate Contest and shall have its own Contest Period. An Entry in one Contest shall not be considered an Entry in any other Contest. In order to enter multiple different Contests, the entrant must enter an answer to the trivia question posed in the applicable Facebook post in the “Comments” section for that specific post.

4. Winner Selection: At the close of the Contest Period as specified above, winners will be randomly selected from eligible Entries by entrants who have correctly answered the trivia question. Drawings will be conducted under the direction of Sponsor, whose decisions are final and binding in all matters relating to the Contest.

5. Notification: Potential winners will be notified within 24 hours of the drawing by direct response on Facebook to their Entry. To claim the prize, the potential winner must respond by direct messaging Sponsor on Facebook within the time frame designated in the notification post and must sign and return the Prize Verification Documents described below, otherwise the prize will be forfeited. Actual odds of winning depend on the total number of Entries received during the Contest Period. If a potential winner cannot be contacted or does not respond within the designated period of time, such potential winner will be disqualified and another potential winner may be selected from the remaining eligible Entries received or Sponsor may cancel the Contest in its sole discretion.

In the event of non-compliance with these Official Contest Rules, or if the prize is unclaimed or returned as undeliverable, the potential winner will be disqualified and another potential winner may be selected from the remaining eligible Entries received or Sponsor may cancel the Contest in its sole discretion. By accepting any prize from Sponsor, the potential winner consents to the use of his or her name, likeness and any other information for any and all advertising/publicity purposes without further consideration and without any additional compensation. The winner expressly waives the right to review any and all advertising bearing his or her names, photographs, likeness, and titles prior to its use. After confirmation of winners, Sponsor may post winners’ names at http://www.facebook.com/FrostBank; http://twitter.com/FrostBank; http://www.instagram.com/frostbank; and/or www.frostbank.com.

6. Prize: Winner will receive two tickets to an upcoming ACL Live taping or a concert at the Moody Theater in Austin, Texas. Substitutions, cash equivalents, or transfer of prizes are not permitted, except at Sponsor’s sole discretion.

7. Winner Verification and Prize Conditions: Potential winners will be required to sign and return to Sponsor any legal documents that Sponsor may require (collectively, “Prize Verification Forms”), including, if necessary, an IRS Form W-9, within the amount of time specified in the email by which the Sponsor delivers the Prize Verification Forms to the potential winner. If a potential winner does not timely sign and return the Prize Verification Documents to Sponsor, or chooses not to accept his/her prize, such potential winner will be disqualified and another potential winner may be selected from the remaining eligible Entries received or Sponsor may cancel the Contest in its sole discretion.

No transfer, substitution, or cash equivalent for the prize is allowed except at Sponsor’s sole discretion. The prize is non-transferable and may not be given, bartered, substituted, sold, or exchanged for cash or another prize. Unused components of the prize have no redeemable cash value.

8. Contest Conditions: By submitting an Entry, each entrant: (i) represents that entrant is eligible to participate in the Contest; (ii) agrees to abide by and be bound by these Official Contest Rules, Sponsor’s Privacy Policy and the decisions of Sponsor on all matters relating to this Contest; (iii) waives any right to claim ambiguity in the Contest or these Official Contest Rules; (iv) forever and irrevocably releases, discharges, indemnifies and holds harmless Sponsor and McGarrah Jessee, and each of their parent, affiliate and subsidiary entities (the “Sponsor Entities”), and each of their respective officers, directors, employees, representatives and agents (the “Released Parties”) from any and all liability, loss or damage of any kind, to the person (including death) or property, resulting in whole or in part, directly or indirectly suffered or resulting from participation in the Contest or the use, misuse or acceptance or possession of a prize or any portion therefor, or participation in any Contest-related activity; (v) except where prohibited by law, grants Sponsor the right to use entrant’s name, address, voice, photograph, likeness, statements, and biographical information on a worldwide basis, in all forms of media, in perpetuity, and for advertising or promotional purposes without a right of review or further approval and without any further compensation or consideration; and (vi) represents and warrants that nothing contained with the Entry will violate the rights of any third parties. By entering the Contest, each entrant will also be subject to the Sponsor’s Privacy Policy as posted on Customer Privacy Statement, where applicable. Receipt of any prize is conditioned upon compliance with any and all applicable federal, state, and local laws, rules, and regulations. Noncompliance with any of the above may result in disqualification. The Released Parties are not responsible for any difficulties or failure connected with the prizes.

Sponsor reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Contest and/or to hold a random drawing among all eligible, non-suspect Entries received prior to such action, if any computer virus, bug, tampering, technical failure, unauthorized human intervention or any other cause outside of Sponsor’s control corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest. In the event of any such modification, cancellation, termination or suspension, a notice of such action will be posted to Frost’s Facebook account (http://www.facebook.com/FrostBank), if then-functioning.

9. Limitation of Liability and Governing Law: The Released Parties are not responsible for any claims, damages, expenses, costs or losses to any person (including death) or property of any kind resulting from or arising from or in connection with, in whole or in part, directly or indirectly: (a) any typographical or other error in the Official Contest Rules, Facebook post containing the trivia question or announcement of any prize; (b) any lost, stolen, damaged, garbled, incomplete, misaddressed, or misdirected Entries, e-mails or other communications; (c) errors, omissions, interruptions, deletions, defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices or transmission lines; (d) data corruptions, theft, destruction, loss, unauthorized access to or alteration of Entries; (e) electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind or insufficient space in entrant’s e-mail account to receive e-mail messages or any suspension, termination or failure of entrant’s Facebook account; or (f) any problems or technical, hardware or software malfunctions of any telephone network or telephone lines, failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in the Contest, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or Entries to be received by the Sponsor due to technical problems, human error or traffic congestion, unavailable network connections on the internet or any website, or any combination thereof, including, without limitation, any injury or damage to entrant’s or any other person’s computer relating to or resulting from participating in the Contest or downloading any materials associated with the Contest. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means will be disqualified. Sponsor reserves the right, at its sole discretion, to disqualify any entrant (and all of his or her Entries) from the Contest or any other promotion conducted now or in the future by Sponsor or any of its affiliated companies, if entrant tampers with the entry process or if entrant’s act of fraud or misconduct affects the integrity of the Contest in any way. Sponsor reserves the right to correct clerical or typographical errors in any promotional or Contest materials.

In addition, the Released Parties shall not be responsible for any cancellations, delays, diversions or substitutions, or any acts or omissions whatsoever by any performer(s)/event(s), or any other persons providing services necessitated by the same. Without limiting the foregoing, the Contest, the prize, and all materials provided on or through the website are provided “As Is” without warranty of any kind, either express or implied, including without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Any claims, judgments and/or awards to entrant shall be limited to entrant’s actual out-of-pocket costs associated with entering the Contest. Entrant hereby waives any rights or claims to attorney’s fees, indirect, special, punitive, incidental or consequential damages of entrant, whether foreseeable or not, and whether based on negligence or otherwise. Some jurisdictions may not allow limitations or exclusion of liability for incidental or consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply. Check local laws for any restrictions or limitations regarding these limitations or exclusions. The Contest will be governed by the laws of the State of Texas, without regard to its rules regarding the conflict of laws. Any and all legal actions or claims relating to or arising in connection with the Contest must be brought in court of competent jurisdiction located in Bexar County, Texas.

Don’t Post Anyone’s Personal or Confidential Information

Remember that Facebook is a public forum, which means that anyone can see your posts and those posts may even show up in search engine results. Please remember that you should never post any personal or confidential information to a public forum like Facebook – whether that information is yours or someone else’s. We will never ask for such information from you via Facebook and you should never provide it via Facebook. You can contact us with your specific financial needs at one of our financial centers, by calling our customer service number (800) 513-7678, and by using our secure frostbank.com website. Please continue to use those channels to reach us regarding your specific financial needs.

Stay on Topic

We expect all users of our Facebook page to stay on topic. At a minimum, that means that you should keep the content of your post on topic within the conversation of the wall post in which you have chosen to participate and should never include any of the following:

  • product ratings or reviews
  • advertisements or “spam”
  • solicitations of any kind
  • critiques of other companies or their products or services
  • investment or other financial advice of any kind

Be Courteous

We expect all of our users to be courteous to each other and to our employees when posting to our Facebook page. Of course, a healthy conversation permits differing viewpoints; however, negative comments or personal attacks directed at other posters are not welcome on our Facebook page and will be removed. We also reserve the right to ban any user from our page without prior notice for violations of Facebook’s policies or our guidelines. And if we believe that any posted comments are criminal in nature, or instigate or promote violence or other criminal activity, we may report such comments and the source of such comments to appropriate authorities.

Respect Other People’s Rights

We expect that, when using our Facebook page, you will not infringe any party’s copyright, patent, trademark, trade secret, or other intellectual property or proprietary right, nor will you violate any other party’s rights of publicity or privacy – or as our lawyers prefer us to say it: By posting to our Facebook page, you represent to us that you own or have been granted all necessary legal rights and permissions required to post such content to our Facebook page and to grant us the permissions granted in these guidelines. If you aren’t sure if you have all required legal rights and permissions to post something to our Facebook page, then please don’t do so.

Know That We May Use Any Content You Post

In providing our Facebook page as a forum for conversation about topics of interest to our customers and potential customers, we expect that there will be many excellent posts, including some that we may want to use in other places and for other purposes. As a result, when you post to our Facebook page, you specifically represent to us that you are at least 18 years of age, and you give us permission, at our discretion, to use your real or social media user name and the content of your post (including all accompanying text, images, videos, artwork and other content) on our website or other social media platforms, in our marketing or advertising materials, or in any other format or context that we may elect to promote Frost Bank and our products and services for such time period as we wish. We have the right to edit your post for brevity, clarity and the like and to modify any image in any manner we deem necessary to use it for the selected format or media. You will not have the right to review or approve our use of your post. You will not receive any compensation for granting us the above rights. If you do not wish to grant us the permission set out in this paragraph, then please do not post to our Facebook page because once you have done so, you will not be able to revoke that permission. In addition, we appreciate any feedback, suggestions or ideas you may provide to us, but if we choose to use or implement them, we are not obligated to compensate you. If you do not want us to use your feedback, suggestions, or ideas without compensating you, please do not submit them to us.

Know That We Monitor Our Facebook Page

While we do monitor our Facebook page and may respond to specific posts, we can’t promise that we will respond to all posts or that our responses will be as prompt as you may hope. If you have specific financial needs that you would like to discuss with us, please visit one of our financial centers, our secure frostbank.com website, or call our customer service number (800) 513-7678 to discuss those needs. Similarly, if we identify a post on our Facebook page that appears to involve a service request or other customer relationship matter, we may invite the poster to contact us by one of the foregoing methods. Of course, we also monitor our Facebook page to determine whether our guidelines are being followed and our company values are being upheld. We reserve the right to remove any post from our Facebook page at any time for any reason without notice. And while we may occasionally remove posts that we believe don’t comply with our guidelines or company values, we do not promise that we will remove all posts, or any specific post, that you or any other user may believe should be removed.

Appreciate That We Are Not the Source of All Posts on Our Page

Much like we are inviting you to post to our Facebook page, we have invited others to do the same. As a result, we are not the source of all of the posts on our Facebook page and thus cannot be responsible for any views expressed other than our own. And while we have asked all Frost employees to identify themselves when posting to this page so that you are aware of their connection to us, the views that they express are not necessarily those of Frost Bank. Only posts made by “Frost” should be considered posts by Frost Bank.

Privacy of Children

Only the parent or legal guardian of a child under the age of 13 may utilize any services we provide, even when a deposit or other account has been established on behalf of the child. Therefore, as with our websites, our social media sites are not directed to or intended for use by children under the age of 13. Visit the Federal Trade Commission website for more information about the Children's Online Privacy Protection Act (COPPA). Should you have additional questions or concerns, please call customer service at (800) 513-7678.

Links to Third Party Sites in Posts on Our Page

We may sometimes include third-party links in our posts to sites which we think our customers and potential customers may be interested in visiting. Our posting of such links is not an endorsement of any such third-party site, nor are we responsible for the contents, policies or terms of use of such sites. Please note, however, that we discourage clicking on links posted by any Facebook users appearing on our Facebook page other than by “Frost” because such links may pose risks to your computer, such as viruses, Trojan horses and the like, or may redirect you to inappropriate or offensive sites.

Reporting Phishing or Other Criminal Conduct

When internet fraudsters impersonate a business to trick you into giving out your personal information, it’s called “phishing.” You should never reply to email, texts, tweets, posts or pop-up messages that ask for your personal or financial information, nor should you click on links within such e-mails, texts, tweets, posts or pop-ups – even if the message seems to be from Frost or another organization you trust. Legitimate businesses do not ask you to send sensitive information through insecure channels. As we stated above, Frost will never ask for any such information from you via Facebook and you should never provide it via Facebook. If you believe that you have received an e-mail, text, tweet, post or pop-up that is a phishing message, we request that you not use Facebook to report such phishing (or any other criminal activity for that matter) to us. Instead, please call our customer service number (800) 513-7678 to speak to a representative about how to make such a report to us.

Don’t Get Us Confused with Facebook

While we really like being a part of the Facebook community of users, Frost Bank is not affiliated with Facebook, Inc. We are not responsible for Facebook’s privacy or security policies (or for any of its other policies or practices for that matter), nor are we responsible for how Facebook or any other third party may use the information that you share on our page. If you haven’t already done so, you should familiarize yourself with Facebook’s privacy settings and use them in the manner you deem appropriate. To learn more about how we may use the information you provide us, please view our privacy policy. As a result, when you post comments to our Instagram page, you specifically represent to us that you are at least 18 years of age, and you give us permission, at our discretion, to use your real or social media user name and the content of your posted comments (including all accompanying text, images, videos, artwork and other content) on our website or other social media platforms, in our marketing or advertising materials, or in any other format or context that we may elect to promote Frost Bank and our products and services for such time period as we wish. We have the right to edit your posted comments for brevity, clarity and the like and to modify any image you post as part of your comments in any manner we deem necessary to use it for the selected format or media. You will not have the right to review or approve our use of your posted comments. You will not receive any compensation for granting us the above rights. If you do not wish to grant us the permission set out in this paragraph, then please do not post comments to our Instagram page because once you have done so, you will not be able to revoke that permission. In addition, we appreciate any feedback, suggestions or ideas you may provide to us, but if we choose to use or implement them, we are not obligated to compensate you. If you do not want us to use your feedback, suggestions, or ideas without compensating you, please do not submit them to us.

Know That We Monitor Our Instagram Page

While we do monitor our Instagram page and may respond to specific posted comments, we can’t promise that we will respond to all posts or that our responses will be as prompt as you may hope. If you have specific financial needs that you would like to discuss with us, please visit one of our financial centers, our secure frostbank.com website, or call customer service at (800) 513-7678 to discuss those needs. Similarly, if we identify a posted comment on our Instagram page that appears to involve a service request or other customer relationship matter, we may invite the poster to contact us by one of the foregoing methods. Of course, we also monitor our Instagram page to determine whether our guidelines are being followed and our company values are being upheld. We reserve the right to remove any posted comment from our Instagram page at any time for any reason without notice. And while we may occasionally remove posted comments that we believe don’t comply with our guidelines or company values, we do not promise that we will remove all posted comments, or any specific posted comments, that you or any other user may believe should be removed.

Appreciate That We Are Not the Source of All Posted Comments on Our Page

Much like we are inviting you to post comments to our Instagram page, we have invited others to do the same. As a result, we are not the source of all of the posted comments on our Instagram page and thus cannot be responsible for any views expressed other than our own. Only posts made by “Frost” should be considered comments by Frost Bank – even if someone else’s post claims that such person works for Frost Bank.

Links to Third Party Sites in Posted Comments on Our Page

We may sometimes include third-party links in our posted comments to sites which we think our customers and potential customers may be interested in visiting. Our posting of such links is not an endorsement of any such third-party site, nor are we responsible for the contents, policies or terms of use of such sites. Please note, however, that we discourage clicking on links posted by any Instagram users appearing on our Instagram page other than by “Frost” because such links may pose risks to your computer, such as viruses, Trojan horses and the like, or may redirect you to inappropriate or offensive sites.

As we stated above, Frost will never ask for any such information from you via Instagram and you should never provide it via Instagram. If you believe that you have received an e-mail, text, tweet, post or pop-up that is a phishing message, we request that you not use Instagram to report such phishing (or any other criminal activity for that matter) to us. Instead, please call customer service at (800) 513-7678 to speak to a representative about how to make such a report to us.

Don’t Get Us Confused with Instagram

While we really like being a part of the Instagram community of users, Frost Bank is not affiliated with Instagram, Inc. Remember that this platform is operated and controlled by Instagram and, therefore, you must strictly comply with all of Instagram’s policies and procedures while using this platform or Instagram’s services and you are subject to whatever actions Instagram may elect to take in order to enforce its policies and procedures. In the unlikely event that you believe that you cannot simultaneously comply with our guidelines and Instagram’s policies and procedures, then you should comply with Instagram’s policies and procedures when accessing and using Instagram’s platform and services, including when accessing and using our page. However, we ask that if you reach the conclusion that you cannot simultaneously comply with both our guidelines and Instagram’s policies and procedures with respect to any comment you intend to post, that you simply do not post such comment to our Instagram page. You should always bear in mind that we do not control if or how Instagram elects to enforce its policies and procedures, whether against you, us or another Instagram user. In addition, we are not responsible for Instagram’s privacy or security policies (or for any of its other policies or practices for that matter), nor are we responsible for how Instagram or any other third party may use the information that you share on our page. If you haven’t already done so, you should familiarize yourself with Instagram’s privacy settings and use them in the manner you deem appropriate. To learn more about how we may use the information you provide us, please view our privacy policy. And because we are not Instagram and this is an official Frost Bank page, your use of this page also is subject to our general terms of use.

Don’t Post Anyone’s Personal or Confidential Information

Remember that LinkedIn is a public forum, which means that anyone can see your posts and those posts may even show up in search engine results. Please remember that you should never post any personal or confidential information to a public forum like LinkedIn – whether that information is yours or someone else’s. We will never ask for such information from you via LinkedIn and you should never provide it via LinkedIn. You can contact us with your specific financial needs at one of our financial centers, by calling our customer service number (800) 513-7678, and by using our secure frostbank.com website. Please continue to use those channels to reach us regarding your specific financial needs.

Stay on Topic

We expect all users of our LinkedIn page to stay on topic.

We expect all of our users to be courteous to each other and to our employees when posting comments to our LinkedIn page. Of course, a healthy conversation permits differing viewpoints; however, negative comments or personal attacks directed at other posters are not welcome on our LinkedIn page and will be removed. We also reserve the right to ban any user from our page without prior notice for violations of LinkedIn’s policies or our guidelines. And if we believe that any posted comments are criminal in nature, or instigate or promote violence or other criminal activity, we may report such comments and the source of such comments to appropriate authorities.

Respect Other People’s Rights

We expect that, when using our LinkedIn page, you will not infringe any party’s copyright, patent, trademark, trade secret, or other intellectual property or proprietary right, nor will you violate any other party’s rights of publicity or privacy – or as our lawyers prefer us to say it: By posting comments to our LinkedIn page, you represent to us that you own or have been granted all necessary legal rights and permissions required to post such content to our LinkedIn page and to grant us the permissions granted in these guidelines. If you aren’t sure if you have all required legal rights and permissions to post something to our LinkedIn page, then please don’t do so.

As a result, we are not the source of all of the posts on our LinkedIn page and thus cannot be responsible for any views expressed other than our own. And while we have asked all Frost employees to identify themselves when posting to this page so that you are aware of their connection to us, the views that they express are not necessarily those of Frost Bank. Only posts made by “Frost” should be considered posts by Frost Bank.
