Reporting Phishing or Other Criminal Conduct

Official Contest Rules
The ACL Live Ticket Giveaway Contest (the “Contest”) is sponsored by Frost Bank, 100 West Houston Street, San Antonio, TX 78205 (“Sponsor”). No purchase or other obligation is necessary to enter the Contest or to claim a prize. All entries that comply with these Official Contest Rules have an equal chance of winning.
1. Eligibility: Entrants must be: (i) a legal resident of the 50 United States or the District of Columbia; and (ii) at least 18 years of age at the time of entry. Employees of Frost Bank and McGarrah Jessee (including employees of any of their respective parent, affiliate or subsidiary entities) are not eligible to win. The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law. Information about entrants will not be shared with third parties and will be used solely for the purpose of notifying the winners.
2. Contest Period: The Contest begins at the time it is posted on Facebook and ends at the time specified in the post (the “Contest Period”).
3. How to Enter: Entrants must enter in the “Comments” section for the specific post made by Sponsor on Facebook an answer to the trivia question posed in the applicable post (individually an “Entry” and collectively the “Entries”). Limit one Entry per person. Each Entry must be submitted in accordance with the instructions during the Contest Period. Only Entries submitted during the Contest Period as described herein will be eligible to win. All properly submitted Entries will be automatically entered into the Contest. Entries in excess of the stated limits will be disqualified. The website’s database clock will be the official timekeeper for the Contest. In the event of a dispute concerning the identity of any entrant, the relevant Entry will be deemed submitted by the authorized holder of the applicable Facebook account used to enter. Sponsor may run multiple ACL Live Ticket Giveaway Contests, simultaneously or over time, using different trivia questions. Each separate trivia question constitutes a separate Contest and shall have its own Contest Period. An Entry in one Contest shall not be considered an Entry in any other Contest. In order to enter multiple different Contests, the entrant must enter an answer to the trivia question posed in the applicable Facebook post in the “Comments” section for that specific post.
4. Winner Selection: At the close of the Contest Period as specified above, winners will be randomly selected from eligible Entries by entrants who have correctly answered the trivia question. Drawings will be conducted under the direction of Sponsor, whose decisions are final and binding in all matters relating to the Contest.
5. Notification: Potential winners will be notified within 24 hours of the drawing by direct response on Facebook to their Entry. To claim the prize, the potential winner must respond by direct messaging Sponsor on Facebook within the time frame designated in the notification post and must sign and return the Prize Verification Documents described below, otherwise the prize will be forfeited. Actual odds of winning depend on the total number of Entries received during the Contest Period. If a potential winner cannot be contacted or does not respond within the designated period of time, such potential winner will be disqualified and another potential winner may be selected from the remaining eligible Entries received or Sponsor may cancel the Contest in its sole discretion.
In the event of non-compliance with these Official Contest Rules, or if the prize is unclaimed or returned as undeliverable, the potential winner will be disqualified and another potential winner may be selected from the remaining eligible Entries received or Sponsor may cancel the Contest in its sole discretion. By accepting any prize from Sponsor, the potential winner consents to the use of his or her name, likeness and any other information for any and all advertising/publicity purposes without further consideration and without any additional compensation. The winner expressly waives the right to review any and all advertising bearing his or her names, photographs, likeness, and titles prior to its use. After confirmation of winners, Sponsor may post winners’ names at http://www.facebook.com/FrostBank; http://twitter.com/FrostBank; http://www.instagram.com/frostbank; and/or www.frostbank.com.
6. Prize: Winner will receive two tickets to an upcoming ACL Live taping or a concert at the Moody Theater in Austin, Texas. Substitutions, cash equivalents, or transfer of prizes are not permitted, except at Sponsor’s sole discretion.
7. Winner Verification and Prize Conditions: Potential winners will be required to sign and return to Sponsor any legal documents that Sponsor may require (collectively, “Prize Verification Forms”), including, if necessary, an IRS Form W-9, within the amount of time specified in the email by which the Sponsor delivers the Prize Verification Forms to the potential winner. If a potential winner does not timely sign and return the Prize Verification Documents to Sponsor, or chooses not to accept his/her prize, such potential winner will be disqualified and another potential winner may be selected from the remaining eligible Entries received or Sponsor may cancel the Contest in its sole discretion.
No transfer, substitution, or cash equivalent for the prize is allowed except at Sponsor’s sole discretion. The prize is non-transferable and may not be given, bartered, substituted, sold, or exchanged for cash or another prize. Unused components of the prize have no redeemable cash value.
8. Contest Conditions: By submitting an Entry, each entrant: (i) represents that entrant is eligible to participate in the Contest; (ii) agrees to abide by and be bound by these Official Contest Rules, Sponsor’s Privacy Policy and the decisions of Sponsor on all matters relating to this Contest; (iii) waives any right to claim ambiguity in the Contest or these Official Contest Rules; (iv) forever and irrevocably releases, discharges, indemnifies and holds harmless Sponsor and McGarrah Jessee, and each of their parent, affiliate and subsidiary entities (the “Sponsor Entities”), and each of their respective officers, directors, employees, representatives and agents (the “Released Parties”) from any and all liability, loss or damage of any kind, to the person (including death) or property, resulting in whole or in part, directly or indirectly suffered or resulting from participation in the Contest or the use, misuse or acceptance or possession of a prize or any portion therefor, or participation in any Contest-related activity; (v) except where prohibited by law, grants Sponsor the right to use entrant’s name, address, voice, photograph, likeness, statements, and biographical information on a worldwide basis, in all forms of media, in perpetuity, and for advertising or promotional purposes without a right of review or further approval and without any further compensation or consideration; and (vi) represents and warrants that nothing contained with the Entry will violate the rights of any third parties. By entering the Contest, each entrant will also be subject to the Sponsor’s Privacy Policy as posted on Customer Privacy Statement, where applicable. Receipt of any prize is conditioned upon compliance with any and all applicable federal, state, and local laws, rules, and regulations. Noncompliance with any of the above may result in disqualification. The Released Parties are not responsible for any difficulties or failure connected with the prizes.
Sponsor reserves the right, at its sole discretion, to modify, cancel, terminate or suspend the Contest and/or to hold a random drawing among all eligible, non-suspect Entries received prior to such action, if any computer virus, bug, tampering, technical failure, unauthorized human intervention or any other cause outside of Sponsor’s control corrupts or affects the administration, security, fairness, integrity or proper conduct of the Contest. In the event of any such modification, cancellation, termination or suspension, a notice of such action will be posted to Frost’s Facebook account (http://www.facebook.com/FrostBank), if then-functioning.
9. Limitation of Liability and Governing Law: The Released Parties are not responsible for any claims, damages, expenses, costs or losses to any person (including death) or property of any kind resulting from or arising from or in connection with, in whole or in part, directly or indirectly: (a) any typographical or other error in the Official Contest Rules, Facebook post containing the trivia question or announcement of any prize; (b) any lost, stolen, damaged, garbled, incomplete, misaddressed, or misdirected Entries, e-mails or other communications; (c) errors, omissions, interruptions, deletions, defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices or transmission lines; (d) data corruptions, theft, destruction, loss, unauthorized access to or alteration of Entries; (e) electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind or insufficient space in entrant’s e-mail account to receive e-mail messages or any suspension, termination or failure of entrant’s Facebook account; or (f) any problems or technical, hardware or software malfunctions of any telephone network or telephone lines, failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in the Contest, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or Entries to be received by the Sponsor due to technical problems, human error or traffic congestion, unavailable network connections on the internet or any website, or any combination thereof, including, without limitation, any injury or damage to entrant’s or any other person’s computer relating to or resulting from participating in the Contest or downloading any materials associated with the Contest. Entries generated by a script, computer programs, macro, programmed, robotic or other automated means will be disqualified. Sponsor reserves the right, at its sole discretion, to disqualify any entrant (and all of his or her Entries) from the Contest or any other promotion conducted now or in the future by Sponsor or any of its affiliated companies, if entrant tampers with the entry process or if entrant’s act of fraud or misconduct affects the integrity of the Contest in any way. Sponsor reserves the right to correct clerical or typographical errors in any promotional or Contest materials.
In addition, the Released Parties shall not be responsible for any cancellations, delays, diversions or substitutions, or any acts or omissions whatsoever by any performer(s)/event(s), or any other persons providing services necessitated by the same. Without limiting the foregoing, the Contest, the prize, and all materials provided on or through the website are provided “As Is” without warranty of any kind, either express or implied, including without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Any claims, judgments and/or awards to entrant shall be limited to entrant’s actual out-of-pocket costs associated with entering the Contest.
